Terms of Service

These Terms of Service ("Terms") govern your access to and use of CheckYourVibe ("we," "us," "our," or "the Service"), a web application security scanning platform. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

CheckYourVibe is a security scanning service for web applications. We perform read-only, non-invasive scans of publicly accessible URLs to identify common security vulnerabilities and misconfigurations.

Our scanner examines HTTP headers, TLS/SSL configuration, DNS records (SPF, DMARC), commonly exposed paths, client-side JavaScript, and CORS policies. It does not modify, write to, penetrate, or exploit your application in any way. All information examined is publicly accessible to any HTTP client.

The scanner identifies itself via the HTTP User-Agent header as CheckYourVibe-Scanner/0.1 in most requests. Site owners may use this identifier to allow or block our scanner at their discretion.

Scan results include plain-English explanations of findings, severity ratings, and copy-paste fix prompts designed for AI coding tools like Cursor and Claude. These results are informational only and do not constitute:

• A comprehensive security audit or penetration test.
• Professional security consulting or advice.
• A certification or guarantee of security.
• A substitute for professional security review by qualified personnel.

• You must provide a valid email address to create an account.
• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• One person or legal entity may not maintain more than one free account.
• You must notify us promptly at privacy@checkyourvibe.dev if you become aware of any unauthorized access to your account.
• We reserve the right to reclaim or reassign account names that are inactive, misleading, or infringing on trademarks.
• You may not use another person's account without their permission.

CheckYourVibe offers multiple tiers. Current plan details, features, scan limits, and pricing are listed on our pricing page.

Free Preview

• Free Preview accounts let you evaluate the Service before subscribing.
• Free accounts are limited to a fixed number of scans and monitored sites, as shown on the pricing page.
• Free Preview accounts expire after a limited evaluation period. After expiry, scanning is disabled until you subscribe to a paid plan.
• Scheduled scans and verification re-scans are not available on the free tier.
• We may modify or discontinue the free tier at any time without notice.

Paid Subscriptions

• Billing cycle: paid subscriptions are billed monthly through Stripe, our third-party payment processor.
• Free trials: certain paid plans include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the listed price.
• Cancellation: you may cancel your subscription at any time through the Stripe billing portal or by contacting us. Your access continues until the end of your current billing period. No partial-month refunds are issued for cancellations.
• Refunds: refund requests are evaluated on a case-by-case basis. Contact us at privacy@checkyourvibe.dev if you believe you were charged in error.
• Price changes: we may change pricing with at least 30 days' notice. Existing subscribers retain their current price until the end of their billing period following the change.
• Payment processing: all payment processing is handled securely by Stripe. We do not store, process, or have access to your full credit card number. Stripe's handling of your data is subject to Stripe's Privacy Policy.
• Failed payments: if a payment fails, we may retry the charge as permitted by Stripe. If payment cannot be collected after reasonable attempts, your account may be downgraded or suspended.

You agree to use CheckYourVibe only for lawful purposes. You must not:

• Scan unauthorized targets — scan URLs that you do not own or do not have explicit, documented authorization to scan.
• Malicious use — use the Service for competitive intelligence gathering, harassment, extortion, or any other malicious purpose.
• Circumvent limits — attempt to circumvent scan limits, rate limits, account restrictions, or other usage controls, including by creating multiple free accounts.
• Reverse-engineer — reverse-engineer, decompile, disassemble, or attempt to extract the source code of the scanner engine or analysis logic.
• Resell — resell, redistribute, or commercially exploit scan results as part of a competing security scanning service.
• Disrupt the Service — interfere with or disrupt the Service, its infrastructure, or other users, including through excessive automated access beyond normal usage.
• Overburden — use the Service in any manner that could damage, disable, overburden, or impair our servers, networks, or databases.
• Misrepresent — impersonate another person, misrepresent your affiliation with an entity, or provide false information in connection with your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice. In cases of severe or repeated violations, we may permanently ban the associated email address and IP address from the Service.

By submitting a URL for scanning, you represent and warrant that:

• You own the website or web application at that URL, or you have explicit written authorization from the owner to scan it.
• The scan does not violate any law, regulation, or contractual obligation applicable to you.
• You understand that our scanner will make HTTP requests to the target URL and its subpaths, which will appear in the target site's server logs.

You are solely responsible for ensuring you have authorization to scan any URL you submit. CheckYourVibe is not responsible for any consequences arising from scans you initiate on sites you do not own or are not authorized to scan.

Our property: the Service, including its scanner engine, analysis algorithms, vulnerability database, user interface, documentation, blog content, and branding, is owned by CheckYourVibe and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

Your data: you retain ownership of the URLs you submit and any data associated with your sites. By using the Service, you grant us a limited, non-exclusive license to access your publicly available URLs solely for the purpose of performing the scans you request and delivering results.

Scan results: scan results generated by the Service are provided for your use. You may use them internally, share them with your development team or clients, or include them in your own reports. You may not resell raw scan output or AI-generated fix prompts as part of a competing service.

Feedback: if you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service without any obligation to you.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

• No guarantee of completeness. Our scanner checks for common security issues but is not a comprehensive security audit, penetration test, or substitute for professional security review. A clean scan does not mean your application is fully secure.
• No guarantee of accuracy. While we strive for accurate results, scan findings may include false positives or miss certain vulnerabilities. You should independently verify findings before taking action.
• You are responsible for fixes. We provide findings and remediation suggestions, but implementing fixes is your responsibility. We are not liable for damages resulting from vulnerabilities, whether detected or undetected by the Service.
• AI-generated prompts are suggestions. Fix prompts generated by AI are starting points, not guaranteed solutions. They may not be appropriate for your specific technology stack, configuration, or security requirements. Always review generated code before applying it to production.
• No uptime guarantee. We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• Third-party services. We rely on third-party services (hosting, email, payments) that are outside our control. We are not responsible for outages or issues caused by those services.

To the maximum extent permitted by applicable law, our total aggregate liability to you for any and all claims arising from or related to the use of the Service is limited to the amount you actually paid us in the 12 months preceding the event giving rise to the claim. For free accounts, our maximum liability is $0 (zero dollars).

In no event shall CheckYourVibe, its officers, employees, affiliates, or licensors be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, business opportunities, or goodwill.
• Cost of procurement of substitute services.
• Damages resulting from unauthorized access to or alteration of your data.
• Damages resulting from vulnerabilities not detected by the Service.
• Damages resulting from actions you take based on scan results or AI-generated fix prompts.

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages, and even if a limited remedy set forth herein is found to have failed its essential purpose.

You agree to indemnify, defend, and hold harmless CheckYourVibe, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service, including any scans you initiate.
• Your violation of these Terms or any applicable law or regulation.
• Scanning of URLs that you were not authorized to scan.
• Any dispute between you and a third party related to scan results or actions you take based on our findings or AI-generated fix prompts.
• Your content, data, or information submitted to the Service.

• By you: you may delete your account at any time by contacting us at privacy@checkyourvibe.dev. If you have an active subscription, cancellation takes effect at the end of the current billing period.
• By us: we may suspend or terminate your account at any time if you violate these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice when possible, except in cases of severe violations.
• Effect of termination: upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.
• Refund on termination by us: if we terminate your account for reasons other than Terms violations while you have an active paid subscription, you will receive a prorated refund for the unused portion of your billing period.
• Outstanding obligations: termination does not relieve you of obligations to pay any fees owed prior to termination.
• Survival: the following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

Informal Resolution First

We want to address your concerns without a formal legal case. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at privacy@checkyourvibe.dev. We will attempt to resolve the dispute informally within 30 days.

Binding Arbitration

If a dispute is not resolved informally, you and CheckYourVibe agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except that either party may bring suit in court to enjoin infringement or other misuse of intellectual property rights. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) on an individual basis.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. Class actions and class arbitrations are not permitted under these Terms.

Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court for matters related to data security, intellectual property, or unauthorized access.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Delaware.

We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your account) or by posting a prominent notice on the Service at least 14 days before the changes take effect.

Non-material changes (such as clarifications or formatting) may take effect immediately. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion.

• Entire agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and CheckYourVibe regarding the Service and supersede any prior agreements or understandings.
• Severability: if any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
• Waiver: our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or the right to enforce it in the future.
• Assignment: you may not assign or transfer your account or rights under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, with notice to you.
• Force majeure: we shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including natural disasters, government actions, pandemics, internet or infrastructure outages, or third-party service failures.
• Notices: we may provide notices to you via email to the address on file with your account or by posting on the Service. Notices to us should be sent to privacy@checkyourvibe.dev.
• No third-party beneficiaries: these Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
• Headings: section headings are for convenience only and have no legal or contractual effect.
